PROGRAMS & PROJECTS> Habitat Participation
A project that disturbs any type of habitat for any non-agricultural activity is a project that has the potential to participate in the San Joaquin Habitat Conservation Plan. The Plan was implemented in San Joaquin County in order to streamline the development process for developers. Under the Endangered Species Act (ESA), developers are responsible to ensure there is no "take" of endangered or threatened species by cause of their development. Before the Plan was in place, developers needed to set up private consultation with the United States Fish and Wildlife Service (USFWS) and the California Department of Fish and Game (CDFG) to complete this task, which proved to be a very lengthy and costly process. The Plan is permitted to operate through USFWS Section 10 and CDFG Section 2081 permits, therefore developers can now choose to use the Plan and take care of their ESA mitigation rather easily. For most projects, the impact area can be evaluated, a biological survey will be prepared, and coverage can be granted in roughly 4-6 weeks. The impact to species is also a factor, so developers are also required to sign an agreement to implement Incidental Take Minimization Measures (ITMMs) in a attempt to have the least amount of impact to the species covered as possible. Individual Species Fact Sheets are listed below. Most cities within the county administer the Plan themselves while others leave all arrangements in the hands of the SJCOG, Inc. staff. All information and forms that would be needed to initiate the coverage process under the Plan can be found below.
